Terms of Service

These Terms of Service ("Terms") govern your access to and use of the CandorVoice platform and website (the "Service"). By creating an account or using the Service, you agree to these Terms on behalf of yourself and, where applicable, the organization you represent.

1. Agreement to the Terms

If you do not agree to these Terms, do not use the Service. If you use the Service for an organization, you confirm you have authority to bind that organization.

2. Eligibility and authority

The Service is a business tool intended for organizations and their authorized users. You must be legally able to enter into these Terms and, where you act for an employer, authorized to do so.

3. The Service

CandorVoice lets employees and frontline staff submit feedback (including anonymously), and gives organizations tools to read, categorize, discuss, act on and measure that feedback, with AI-assisted analysis where enabled.

4. Accounts and security

You are responsible for your account credentials and for activity under your account. Notify us promptly of any suspected unauthorized access.

5. Organizations and workspaces

An organization may invite users and assign roles and permissions. The organization's administrators control access, settings and the data within its workspace.

6. Customer responsibilities

The customer organization is responsible for: the lawfulness of its feedback program; providing any required employee notices; complying with employment, labor and data-protection law; responding to feedback and complaints; all HR and employment decisions; the conduct of its administrators; and the permissions and lawful basis for the data it collects.

7. Employee feedback and submitted content

Feedback submitted through a workspace is controlled by the customer organization, which decides how it is used and retained. Customers must not use the Service to process data they are not lawfully permitted to process.

8. Anonymous feedback

We design anonymous submission so that a name is not attached unless the submitter chooses to provide one. We do not and cannot guarantee absolute anonymity: a person may identify themselves, or be identifiable from the content of what they write, and we process ordinary technical and security information as described in our Privacy Policy. You must not attempt to identify an anonymous submitter through unlawful means.

9. Acceptable use

Use the Service lawfully and only for its intended purpose. Do not submit content you are not entitled to submit, and do not use the Service to harm others.

10. Prohibited conduct

You must not: threaten or harass others; submit illegal content; upload malware; impersonate any person; attempt to identify anonymous submitters unlawfully; circumvent access controls; scrape or attack the Service; or infringe intellectual property rights.

11. AI-assisted features

AI features may generate classifications, summaries, patterns, suggested actions and marketing content. Output may be inaccurate or incomplete. AI output is assistive only and requires human review before any consequential decision.

12. No employment, legal, medical or other professional advice

The Service provides tools and information. It does not provide legal, HR, medical or other professional advice, and it does not determine whether any conduct occurred.

13. Customer decisions and human review

The customer retains responsibility for all employment decisions. CandorVoice does not make hiring, firing, promotion, discipline or compensation decisions. Consequential decisions must be made by people.

14. Intellectual property

CandorVoice and its licensors own the Service, including its software, design and trademarks. No rights are granted except as expressly stated in these Terms.

15. Customer content ownership

The customer (and its users) retain ownership of the content they submit. CandorVoice does not acquire ownership of customer content.

16. License to operate the Service

The customer grants CandorVoice a limited license to host, process, transmit and display customer content solely to provide and support the Service, and as otherwise described in the Privacy Policy.

17. Feedback about CandorVoice

If you send us suggestions about CandorVoice, we may use them without obligation or restriction.

18. Third-party services

The Service relies on third-party providers (for example hosting, email delivery, payment processing and AI providers). Their terms may apply to their own services.

19. Social publishing integrations

Where CandorVoice's own marketing automation publishes through a social provider, publication is subject to that provider's rules. CandorVoice does not publish to a customer's social accounts through this feature.

20. Subscriptions and payment

Paid plans are billed through our payment processor in advance or as otherwise agreed. Subscriptions renew unless cancelled.

21. Trials and promotions

Trials or promotional offers are governed by the terms presented when they are offered and may be withdrawn prospectively.

22. Taxes

Fees are exclusive of taxes unless stated. The customer is responsible for taxes other than those based on our income, where applicable.

23. Cancellation

You may cancel your subscription at any time; access continues until the end of the paid period unless stated otherwise.

24. Suspension and termination

We may suspend or terminate access for material breach of these Terms, unlawful use, or risk to the Service or other customers. You may stop using the Service at any time.

25. Data export and deletion after termination

On request, and subject to law, customers can export their content. After termination, customer content is deleted in line with the Privacy Policy and the applicable contract.

26. Confidentiality

Each party will protect the other's confidential information with reasonable care and use it only to perform these Terms.

27. Privacy

Our Privacy Policy and Cookie Policy describe how we handle personal data and cookies.

28. Security

We apply reasonable technical and organizational measures to protect the Service. No system can be guaranteed completely secure.

29. Disclaimers

The Service is provided on an "as available" basis. To the extent permitted by law, we disclaim implied warranties, including fitness for a particular purpose. We do not warrant uninterrupted or error-free operation.

30. Limitation of liability

To the extent permitted by law, neither party is liable for indirect, incidental, special or consequential damages, or lost profits or data. Our aggregate liability is limited to the fees paid for the Service in the period specified in our legal configuration before the event giving rise to liability. Nothing here limits liability that cannot lawfully be limited.

31. Indemnification

The customer will indemnify CandorVoice against third-party claims arising from the customer's content, its feedback program, or its breach of these Terms.

33. Changes to these Terms

We may update these Terms; the "last updated" date will change and material changes will be communicated through the Service.

34. General

If any provision is unenforceable, the rest remains in effect. These Terms are the entire agreement about the Service between the parties, and are not assignable without consent, except to a successor.

36. Employee Feedback

CandorVoice provides a channel through which employees and other authorised workplace participants can share Feedback with the organisation responsible for the relevant Location. By submitting Feedback through this channel, you agree to these Terms.

Purpose of the channel

The Feedback channel may be used to share workplace problems, safety concerns, process or operational issues, workplace experiences, suggestions and ideas, and things that are working well.

The organisation receiving the Feedback decides how it is reviewed and what action, if any, should be taken. CandorVoice does not guarantee that every submission will result in a specific action or outcome.

Submit information in good faith

Please submit information you reasonably believe to be accurate, relevant and made in good faith. CandorVoice is intended to make legitimate speaking up easier.

The channel must not be deliberately used to knowingly submit false information, threaten or harass another person, impersonate someone else, submit unlawful content, or deliberately interfere with the service.

Anonymous or named Feedback

Employees may submit anonymously where the organisation has enabled that option. Anonymous submission means the form does not require the employee to provide their name.

The content of a message may itself reveal someone’s identity. If you wish to remain anonymous, avoid including unnecessary identifying information in your message.

Personal information

Please avoid including unnecessary personal information about yourself or other people. Where information about another person is genuinely relevant to a workplace concern, provide only what is reasonably necessary to explain the issue. Personal information is handled according to the applicable Privacy Notice and the organisation’s policies.

Who may see Feedback

Feedback may be available to authorised users responsible for reviewing or managing Feedback for the relevant Location or workspace, according to their access permissions.

Protecting the channel from misuse

CandorVoice may use limited technical information to protect the Feedback channel from repeated misuse, as described in the Privacy Notice.

What may happen after Feedback is submitted

Authorised management may use CandorVoice to review the Feedback, categorise or prioritise it, create an Action, assign an owner, set a due date, publish a What changed employee update, ask a follow-up Poll, and include aggregated information in Reports.

Urgent or emergency situations

CandorVoice is not an emergency service. If there is an immediate risk to life, health or safety, use the appropriate emergency services and your organisation’s emergency procedures.

Formal reporting and whistleblowing

CandorVoice may complement an organisation’s internal reporting processes, but it is not automatically a substitute for any formal grievance, whistleblowing, regulatory or legally required reporting channel. Where your organisation provides formal procedures, follow them as required.

Privacy

Information submitted through CandorVoice is handled as described in the applicable Privacy Notice. Read the Privacy Policy.
